Adball ("Adball",
"adball", "us"
or "we")
respects the privacy of the users and visitors of its
website/platform. Adball's homepage,
http://www.adball.com, is herein referred to as the "Website"
or the "Platform".
This Privacy Policy, which is incorporated into the Terms
of Usage is intended to
inform you of our policies and practices regarding the collection,
use and disclosure of any Personal Identifiable Information and Anonymous
Information you submit to us through our Website.
"Personally Identifiable
Information", herein also referred to as PIA
is information that can explicitly identify you, for example
your name, address, e-mail address, or phone number, as well as other
non-public information that is associated with the above and
foregoing. "Anonymous

means information that is not associated with or linked to your
Personally Identifiable Information. Anonymous Information does not permit or allow
the identification of individual persons directly, unless correlated
with other public and/or private information. We collect and use
Personal Information and Anonymous Information as described in this

Summary
The confidential Personally Identifiable
information you provide
when registering with Adball is collected exclusively for use by
Adball, its representatives and agents, its advisors, its customers and its customers business
partners. Adball will use your confidential PIA only insofar as
it allows us to provide our service to you. Adball will not share your
confidential PIA with any parties other than those listed above.
This
applies to all information collected or submitted on adball.com
including but not limited to your name, address, phone number, and
email address.
To prevent unauthorized access, maintain
data accuracy, and ensure the correct use of information, we have put
in place reasonable physical, electronic, and managerial procedures to
safeguard and secure the information we collect online.
The confidential PIA you have provided to Adball may be
accessed and edited by logging into your Adball account and following
the link “Edit Profile ”.

Consent
By
submitting Personally Identifiable Information through Adball's website, you agree
to the terms of this Privacy Policy and you consent to the
processing of your Personally Identifiable Information according to this Privacy
Policy.
Your
Personal Information may be processed by Adball in the country it is collected, i.e., the United
States, where laws regarding processing of Personally Identifiable Information may
be less stringent than the laws in your country..
Collection
of Personally Identifiable Information
The
Personally Identifiable Information we collect helps us learn the
usage patterns of our users. We use this information to
better make our platform more efficient, more scalable and more usable,
and to offer you additional personalized information, as further
described in the section titled "Use
of Information" below.
Personally Identifiable
Information You Provide to Adball
We
collect Personally Identifiable Information that you submit to us voluntarily
through our website. The types of Personally Identifiable Information we collect
are:
When you sign up for an account on
our platform directly or through Facebook Connect, we collect your
first and last name, email address, birth date, gender, zip code or
postal code, country and state/region in which you live, institution name
(if applicable), your security question response and password that
you choose.
When you personalize your Adball
profile, we collect any information you provide, such as your
name or photos you choose for your display picture.
When you enter any PIA into any postings, comments, or
forums within the platform, we collect such information. This
information may be available for some, a subgroup of, or even all
members of the platform depending on how and where this information
was posted by you (see the section titled "Public Places"
below).
When you send us feedback, we will
collect any information that is contained in your feedback.
When you contact us by sending us
an e-mail, we will collect your e-mail address and any information
contained in the e-mail you send us.
When you sign up to, or win, any
campaigns, or other activities that we make available on the
platform, we collect the information designated along with such
activity ("Activity
Information").
Your
Adball account that you create when you sign up for our platform
contains PIA such as your e-mail address
and password. Your email, the first and last name and your photo (if you provide one) may be visible to other members of the
Adball community (the "Adball
Account").
All
the information in your Adball profile is public
information and any Adball member will be able to see it (the "Adball
Profile").
Your Adball Profile may contain PIA.
Personally
Identifiable Information Collected Via Web Technology
As
you browse throught the platform, we may also collect internet
protocols and browser application-specific information, including but
not limited to your Internet protocol (IP)
address, browser type, and operating system. We also use Cookies and
Uniform Resource Locators (URL) to gather
information regarding the date and time of your visit and the
information for which you searched and viewed. This type of
information is collected to for us to understand your usage patterns so
that we can customize the platform to your needs.
An
"Internet
protocol address"
or "IP Address"
is a number that is automatically assigned to your computer when you
use the Internet. In some cases your IP Address stays the same from
browser session to browser session. We track IP Addresses to
collect information about your geographic location and other aspects of your user behavior.
"Cookies"
are small pieces of information that a web site stores on your hard drive while you are viewing a web site. Adball may
use both session Cookies (which expire once you close your web
browser) and persistent Cookies (which stay on your computer until
you delete them) to provide you with a more personal and interactive
experience on the platform. Persistent Cookies can be removed by using the "privacy menu" on your
browser. If you choose to disable Cookies completely, some areas of
the platform may not work properly or be available to you.
We track IP Addresses to
collect information aspects of your user behavior and to provide the basic functionality of our platform.
Adball
may also contract with third parties in order to promote the products
and/or services of these third parties by placing ads on the
platform. We may use information that was posted by users of the
platform, electronically created algorithms, or information regarding
your use of the platform to tailor the display of ads to the interest
of the users. Clicking on such ads may direct you to the website of
the third party and the third party may also use Cookies in
connection with these ads. Be advised that once you have left
the Adball platform, we have no control over your information.
Although Adball makes commercially reasonable efforts to contract
with third parties whose privacy policies are reasonable, Adball is
not responsible for these other websites or any content on these
other websites, and this Privacy Policy does not govern your visit of
these other websites.
The website may display ads that are served by a third-party ad server
which may also collect information regarding the display of, and your
interaction with, ads on the Website, which ads are not regulated by
this Privacy Policy.
Feedback
If
you send us feedback, we may use it for any purpose,
provided we will not associate it with your PIA. Adball will collect any information contained in such
communication and will treat the PIA in such
communication in accordance with this Privacy Policy.
Personal
Information We Receive From Other Sources
We
may receive your PIA from other sources like
telephone or fax, or from third parties that provide services for us
in connection with the Adball platform. We may add this information
to the information we have already collected from you via our
platform in order to improve it and the services we provide. Adball will treat the PIA collected in such fashion in accordance with this Privacy Policy.
Public
Places
Members
of the platform share information. You should thus assume that any
information that you enter or post on the
platform (excluding the nonpublic information in your Adball
Account), may be openly shared with other community members and may
also be available to people who have not registered with the platform.
Depending on where
you post your information, you might be able to further specify which
members or group of members of Adball will be able to have access to
it. Please be aware that if you enter any PIA into public sections of
the platform, this
information will be displayed to anyone who has access to these
sections. Adballwill not have any obligation with respect to any
information that you post to parts of the platform available to
others.
Users
and members are also able to search for PIA that was posted by an Adball user in public sections of
the platform, or for information about a public Adball Profile or public Campaign that you control.
Use
of Information
PIA you submit to Adball is used to either
sign you up, respond to requests that you make, or
to improve the platform and the service it provides. Adball may also
use your PIA to
create and maintain your
account, for research, to send you communications and promotions, and
to customize the advertising content displayed on the platform.
Adball
may aggregate user PIA to create Anonymous
Information. In particular, adball may anonymize PIA records by
excluding information,
such as your name and other pieces that make the information PIA. We
may use this Anonymous
Information to analyze usage patterns so that we may enhance our
platform and service. We may also aggregate the Anonymous information
and display the aggregated locations, age, sex, and any other
anonymous personal information collected by the platform and other
means. We may use the aggregate information to derive statistics, such
as average age per sex. We may also share Anonymous information and/or
aggregated
Anonymous Information with third parties via APIs for the purpose of
providing features and services to our users and customers.Adball
reserves the right to use and disclose Anonymous Information to third
parties at its discretion.
Disclosure
of Personal Information
Unless it is otherwise stated in this Privacy Policy, we do not generally
trade, rent, or share your Personally
Identifiable Information with third parties. We may provide your PIA
to third party service providers who work on behalf of or with Adball
to provide some of the services and features of the Adball platform
and to help us communicate with our users. We may also provide Adball
contributor PIA to Adball customers that launch advertizing campaign
competitions through our platform. We may also provide contributor PIA
to the sponsors of Adball customers that launch advertizing campaign
competitions through the platform. However, these service
providers do not have any independent right to share this information.
We may make your Personal Information available to other organizations
whose products or services we think you might find interesting. If you
are a California resident and you would like to know (1) the categories
of Personal Information that we disclosed in the prior calendar year to
third parties about you for the purposes of the third parties’
marketing and/or (2) the names and addresses of such third parties,
please contact us at contact@adball.com .
Adball currently has no parent company, any subsidiaries, joint
ventures, or other companies under a common control, herein referred to as Affiliates. However,
we may have affiliates in the future. We may share some or all of your
PIA with these Affiliates. In this case, we will require our
Affiliates to honor this Privacy Policy. If Adball is sold, your
PIA will be provided to the new entity and
notification of the sale shall be posted in this privacy policy.
If
our company or our assets are acquired by another company, that
company will possess the PIA collected by us and it
will assume the rights and obligations regarding your Personal
Information as described in this Privacy Policy.
Upon
termination of your account, any content or information submitted
through or associated with your account will be handled as described
in the "Terms of Use".
We
or collaborating parties or affiliates may disclose your PIA if we or they believe in good faith
that such disclosure is necessary to (a) comply with relevant laws or
to respond to subpoenas or warrants served on Adball; (b) to protect
or defend the rights or property of Adball, users of our platform, or
third parties; or (c) to investigate or prevent suspected fraud,
illegal activity, threats to safety, or violations of the Terms of
Use or this Privacy Policy.
Your
Choices Regarding Your Personal Information
Adball
offers you choices regarding the collection, use and sharing of your
Personal Information.
When you receive promotional
communications from us and periodic updates, you may indicate a preference to stop
receiving them. In particular, you will have the option to unsubscribe by following the
instructions provided in the e-mail you receive or by contacting us
directly (please see contact information below).
Despite the e-mail preferences you may indicate, we may send you administrative
emails (e.g., service announcements and newsletters) regarding
our services or notices of any updates to our Terms of Use or Privacy
Policy.
You
may modify your PIA by editing
your Adball Profile and Adball Account, or by requesting that we remove
your Adball Profile or Adball Account. However, you should note that
we will retain your Personal Information in our archives and in
public areas of the site (to the extent you made any public
postings). Furthermore, search engines may maintain copies of your publicly available PIA in their cache systems.
Regarding
Children under 13
We
do not market or intentionally gather PIA of
visitors that are are under the age of 13.
Other
Sites
Our
provision of links to other website(s) or location(s) is for your
convenience and does not signify our endorsement of such other
website(s) or location or its contents. Links to other website(s) or
location(s) may also be posted by other Adball users within the
platform. We have no control over, do not review, and cannot be
responsible for these outside websites or their content. Please be
aware that the terms of our Privacy Policy do not apply to these
outside websites.
Security
We follow reasonable security practices to prevent compromise and leakage of your PIA. However, Adball cannot fully
eliminate security risks associated with PIA.
Privacy
Policy Updates
This
Privacy Policy is subject to occasional revision. If we make any
substantial changes in the way we collect, use, or disclose your
PIA, we will post a notice on this page for at least
30 days. If you object to any such changes, you must cease using our
platform. Continued use of our platform following notice of any such
changes shall indicate your acknowledgement of such changes and
agreement with the terms and conditions of such changes.
